Terms of Service

Please read these Terms carefully before using Built, Not Born™. By accessing the website, creating an account, using the diagnostic, submitting content, leaving a testimonial, or purchasing access, you agree to these Terms and to our Privacy Policy. These Terms are drafted for an India-facing digital product and should be read with applicable Indian consumer, information technology, data protection, contract, payment, intellectual property, and cyber security laws.

1. Who operates the product

Built, Not Born™ and builtnotborn.in refer to an independent digital product by Rishikar Krishna. Unless a separate legal entity is displayed on the website or checkout page, the product is operated by Rishikar Krishna as an individual/proprietary digital product.

The product includes the website, career diagnostic, AI-assisted diagnosis, reader, practice system, email flows, testimonials, paid annual access, analytics, payment flows, and related digital services. This website is not affiliated with, endorsed by, or connected to any other book, podcast, course, company, creator, or business using the words Built Not Born or similar wording.

2. Eligibility and capacity

The product is intended for adults and working professionals. You must be at least 18 years old and legally capable of entering into a binding agreement to create an account, submit content, or purchase access. If you use the product on behalf of an organization, you confirm that you have authority to bind that organization and that you will not submit confidential employer, client, or third-party information without permission.

3. Product purpose and no professional advice

Built, Not Born™ is an educational and reflective product. It helps users notice patterns in workplace behavior, career confidence, communication, authority, visibility, preparation, and decision-making.

The diagnostic, AI-written diagnosis, chapter recommendations, prompts, reflections, emails, and other content are not medical, psychological, psychiatric, therapeutic, legal, financial, tax, recruitment, human-resources, or employment advice. They are not a substitute for a qualified professional, therapist, doctor, lawyer, financial adviser, career counsellor, HR representative, or workplace grievance mechanism.

You remain responsible for your own decisions, workplace actions, health, wellbeing, career choices, finances, legal choices, and relationships. If you are experiencing a medical, mental-health, workplace-safety, legal, or personal-safety emergency, contact qualified professionals or emergency services immediately.

4. No guarantee of outcomes

We do not guarantee promotions, job offers, salary increases, workplace recognition, performance-review outcomes, psychological improvement, emotional outcomes, relationship outcomes, business outcomes, or any particular result. Any examples, testimonials, case studies, sample outputs, chapter references, or marketing claims are illustrative only and do not promise that you will experience the same result.

5. AI-assisted outputs

Some product outputs may be generated or assisted by artificial intelligence. AI outputs can be incomplete, inaccurate, delayed, repetitive, biased, or unsuitable for your specific situation. You should not rely on AI output as factual, professional, medical, psychological, legal, financial, employment, or high-impact decision advice.

We may use fallback logic, structured templates, caching, manual content, or human-written content if an AI service is unavailable, slow, or unsuitable. Product output may vary between users, sessions, and versions. You must not submit trade secrets, employer confidential information, client data, medical records, legal documents, financial account details, passwords, government IDs, or other sensitive material into any free-text field.

6. Account use and security

You are responsible for maintaining the security of your account, device, email, sign-in credentials, and payment access. You agree not to share paid access, allow unauthorized use of your account, bypass account controls, impersonate another person, or use another person's account without permission.

Notify us at support@builtnotborn.in if you believe your account has been accessed without authorization. We are not responsible for losses caused by your failure to keep your account secure.

7. Digital access and product changes

Free access may include one diagnostic run, an AI-assisted diagnosis, and access to a mapped chapter. Paid annual access unlocks the full digital product for the stated access period, subject to these Terms and any checkout terms shown at purchase.

We may improve, modify, replace, restrict, suspend, or discontinue any part of the product, including diagnostics, prompts, chapters, AI features, reader features, pricing, availability, or access rules. We will try to avoid unnecessary disruption, but we do not guarantee uninterrupted, error-free, or permanent availability of any feature.

8. Payments, taxes, cancellation, and refunds

Payments are processed by Razorpay or another listed payment processor. We do not store your full card, bank, UPI, or payment instrument credentials on our servers. You agree to provide accurate billing information and comply with the payment processor's terms.

Because the product is a digital product delivered immediately after payment verification, cancellation after access is delivered is not normally available, and all sales are final to the fullest extent permitted by applicable law. This does not exclude non-waivable consumer rights, statutory remedies, refunds required by law, refunds for duplicate charges, or refunds for verified payment/access failures.

Accepted refunds, if any, will be processed to the original payment method or another lawful method supported by the payment processor within a reasonable period and as required by applicable law, RBI/payment-system rules, or the payment processor. Users cannot self-refund through the platform. Deleting an account does not automatically create a refund.

You are responsible for applicable taxes, bank charges, currency conversion fees, payment gateway fees, and charges imposed by your bank, card issuer, payment provider, or local law.

9. Consumer grievance handling

For customer care, payment issues, access issues, refund requests, rights concerns, data requests, or legal complaints, email support@builtnotborn.in. The grievance contact for this product is Rishikar Krishna / Built, Not Born™ Support at the same email address.

We aim to acknowledge consumer complaints within 48 hours and resolve them within one month from receipt where reasonably possible and where applicable law requires that timeline. Some requests may take longer if they require payment-processor investigation, fraud review, identity verification, legal review, or action by a third-party service provider.

10. Intellectual property and limited license

All original diagnostic material, frameworks, questions, chapter material, prompts, product names, writing, design, interfaces, software, workflows, images, layouts, analytics design, and product experience on this website are owned by Rishikar Krishna or licensed to Built, Not Born™ unless stated otherwise.

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to access and use the product for your own individual learning and reflection. This license does not transfer ownership of any content, software, model prompt, dataset, method, or system.

You may not copy, reproduce, scrape, distribute, resell, sublicense, publish, upload, mirror, frame, modify, translate, reverse engineer, extract prompts from, train AI models on, create competing products from, or commercially exploit any part of the product without written permission. You may not remove copyright, trademark, watermark, attribution, or ownership notices.

11. User content, reflections, and testimonials

You may submit diagnostic responses, written moments, reflections, notes, highlights, testimonials, feedback, support messages, and other content. You confirm that you have the rights needed to submit that content and that it does not violate another person's rights, privacy, confidentiality, contract, employment duty, or applicable law.

Private diagnostic responses, reflections, and account data are handled under the Privacy Policy. If you voluntarily submit a testimonial, review, or public feedback, you grant us a worldwide, royalty-free, non-exclusive license to display, reproduce, edit for length or clarity without changing the meaning, and use that testimonial in connection with Built, Not Born™ marketing, product pages, ads, emails, and communications. You can request removal of a testimonial by emailing us, and we will make reasonable efforts to remove it from future public display.

You may not submit fake reviews, paid reviews without disclosure, impersonated reviews, misleading testimonials, unlawful content, defamatory content, abusive content, discriminatory content, obscene content, confidential information, infringing content, malware, spam, or content that harms children or violates any law. We may refuse, edit, moderate, disable, or remove content at our discretion.

12. IT and cyber misuse restrictions

You agree not to host, display, upload, modify, publish, transmit, store, update, share, or attempt to share any information that:

• belongs to another person and to which you have no right;
• is obscene, pornographic, paedophilic, invasive of privacy, harassing, insulting on the basis of gender, racially or ethnically objectionable, discriminatory, hateful, or harmful to children;
• infringes copyright, trademark, patent, moral rights, publicity rights, privacy rights, confidentiality obligations, or other proprietary rights;
• deceives or misleads others, impersonates another person, or knowingly communicates false or misleading information;
• threatens the unity, integrity, defence, security, sovereignty, friendly relations, public order, decency, or morality of India, or incites an offence;
• contains viruses, malware, spyware, credential harvesters, harmful code, automated scraping, or tools intended to interfere with the product or its infrastructure;
• violates any law for the time being in force.

You also agree not to probe, scan, attack, overload, reverse engineer, bypass, circumvent, or interfere with the website, APIs, authentication, payments, analytics, rate limits, security controls, or infrastructure.

13. Legal takedown, lawful access, and preservation

We may remove or disable access to content, accounts, links, or data where we receive lawful notice, court order, government direction, payment-provider notice, rights-owner notice, security notice, or credible evidence of misuse. We may preserve records where required for fraud prevention, dispute handling, cyber security, investigation, or legal compliance.

We may cooperate with lawfully authorized government agencies, courts, regulators, payment processors, cyber security authorities, or law-enforcement agencies, including for prevention, detection, investigation, prosecution, cyber incidents, and compliance with valid legal process. We may report applicable cyber security incidents to CERT-In or other competent authorities where required.

14. Privacy and data protection

Your use of the product is governed by the Privacy Policy. The Privacy Policy explains our role as a data fiduciary/controller for the product, what personal data is collected, why it is processed, how it is shared with processors, how long it is retained, how to withdraw consent, how to make rights requests, and how to raise a privacy grievance.

15. Third-party services

The product may rely on third-party services including Google Sign-In, Razorpay, Supabase, Resend, Google Analytics, Microsoft Clarity, hosting providers, email providers, AI infrastructure providers, fraud-prevention tools, and payment infrastructure. Your use of those services may be subject to their own terms and privacy policies.

We are not responsible for third-party outages, security incidents, policy changes, payment failures, authentication failures, analytics behavior, data-center issues, network issues, or service limitations outside our reasonable control.

16. High-impact and prohibited uses

You must not use the product to make, automate, or materially influence high-impact decisions about employment, hiring, firing, promotion, credit, insurance, housing, education, medical care, legal rights, financial eligibility, immigration, or access to essential services. The product is for individual reflection only.

17. Suspension and termination

We may suspend, restrict, or terminate your access if we reasonably believe you have violated these Terms, created risk for the product or other users, abused support or payment systems, infringed intellectual property, engaged in fraud, attempted unauthorized access, violated platform rules, or used the product unlawfully.

You may stop using the product at any time. Account deletion and data deletion are handled as described in the Privacy Policy. Sections that by their nature should survive termination will continue to apply, including payment obligations, intellectual-property restrictions, disclaimers, liability limitations, indemnity, dispute terms, governing law, and compliance cooperation.

18. Availability, security, and force majeure

We work to keep the product reliable and secure, but no online service is perfectly secure or continuously available. The website may be unavailable because of maintenance, updates, hosting issues, DNS issues, payment-provider outages, AI-provider outages, browser changes, internet disruptions, legal restrictions, security incidents, cyberattacks, or events outside our reasonable control.

We are not liable for delay or failure caused by events beyond our reasonable control, including acts of God, war, civil disturbance, strikes, outages, cyberattacks, government action, platform-provider action, payment-provider action, or network failure.

19. Disclaimer of warranties

To the fullest extent permitted by applicable law, the product is provided on an "as is" and "as available" basis. We disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of accuracy, completeness, reliability, merchantability, fitness for a particular purpose, non-infringement, availability, security, and uninterrupted operation.

20. Limitation of liability

To the fullest extent permitted by applicable law, Built, Not Born™, Rishikar Krishna, and any associated service providers, contractors, or representatives will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for loss of data, reputation, goodwill, opportunity, employment outcome, business, revenue, anticipated savings, or workplace relationship.

To the fullest extent permitted by applicable law, our total liability for any claim related to the product or these Terms will not exceed the amount you paid to us for the product in the twelve months before the claim, or INR 1,000, whichever is higher. Some laws may not allow certain limitations; in that case, the limitation applies to the maximum extent allowed by law.

21. Indemnity

You agree to defend, indemnify, and hold harmless Built, Not Born™, Rishikar Krishna, and any associated service providers, contractors, and representatives from any claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from your use of the product, your content, your breach of these Terms, your violation of law, your misuse of AI output, your violation of another person's rights, or your submission of confidential or unlawful information.

22. Statutory rights not excluded

Nothing in these Terms excludes or limits rights, remedies, warranties, liabilities, or obligations that cannot be excluded or limited under applicable Indian consumer protection, data protection, information technology, payment, intellectual property, cyber security, or other laws. If a clause is narrower than a mandatory legal requirement, the mandatory legal requirement will apply.

23. Rights concerns and takedown requests

If you believe any material on the website infringes your rights or raises a legal concern, email support@builtnotborn.in with your name, contact details, the material at issue, the right you believe is affected, and enough information for us to review the concern. We may remove, restrict, or modify content while we assess a concern.

24. Changes to these Terms

We may update these Terms from time to time. If changes are material, we may provide notice by email, in-product notice, or website notice. Continued use of the product after updated Terms are posted means you accept the updated Terms. If you do not agree to the updated Terms, stop using the product and contact support about any active paid access.

25. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Before starting formal proceedings, both sides agree to try in good faith for 30 days to resolve any dispute by email or written communication.

Subject to applicable law and non-excludable consumer-forum rights, disputes will be handled by courts of competent jurisdiction in India. Nothing in these Terms limits rights that cannot be limited under applicable consumer, privacy, or digital-services laws.

26. General terms

If any part of these Terms is found invalid or unenforceable, the remaining parts will continue in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later. You may not assign or transfer your rights under these Terms without written permission. These Terms, together with the Privacy Policy and any payment or access terms shown at checkout, form the entire agreement between you and us regarding the product.
